When engaged in the process of writing medico-legal reports I aim to:
- Complete reports within 1 month of assesment with the client (unless agreed with the client)
- Provide an express report service within 2 weeks of assessment
- Respond to correspondance within 3 working days
- Respond to any instructor enquiries within 3 working days
- See the client within 3 weeks of instruction
- Honour requests for minor report alterations except where such alterations conflict with the expert opinion
- Give notice of unavailable dates for court on request and reserve requested court dates to a maximum of 3 days for up to 42 days before the case
My terms are as follows
(1) I will fulfil your instructions to the best of my ability as an independent witness. I will apply my experience, care and skill in the best interests of the legal process.
(2) I cost my time within the recommendations of the Legal Services Commission for all time spent on the case.
(3) Preparation of a medical report would involve examination of client, reading relevant documentation and meeting significant parties.
(4) My fees range from £500 to £850, depending on the complexity of the case. This does not include VAT.
(5) My fees in respect of a "without prejudice" meeting or conference with counsel would be £120 per hour including time for travelling and waiting.
(6) I will not act on a "no win no fee" basis as this may prejudice my independent status and bias any report
(7) My daily rate for attending court to give expert evidence is £2,000 per day or part thereof which includes time for travelling and waiting. I expect payment even if I do not give oral evidence.
(8) Reasonable travelling expenses will be required for attending court or meetings. Copies of receipts will be provided should they be requested.
(9) There would be a contingency cancellation fee of £600 per day if, for any reason whatsoever, any need to attend court is cancelled and I am given less than two working days' notice. This is in addition to my charges for time incurred to that date.
(10) The solicitor's firm instructing me shall be liable for my fee, whether or not recovery from the client or defendant is achieved. Payment is normally due at the end of the case.
(11) In legally aided cases (where my fees are considered a disbursement), I expect a prompt claim to be made to the the Legal Aid Board and to advise me of any expected delay in settlement. In all other cases, I expect payment within 30 days of the invoice date irrespective of whether a client has paid you (unless agreed beforehand).
A comprehensive report would require copies of the following documentation prior to examination:
(a) General Practitioner's medical records.
(b) Hospital records.
(c) Copies of associated reports from other expert witnesses assessing the client since the injury.
